Scott A. Schweber serves as a full-time mediator and arbitrator for Henning Mediation and Arbitration in Atlanta, GA handling a wide range of civil matters including complex business and commercial disputes. His work draws on extensive prior experience as a trial attorney representing clients in a wide range of civil matters, as well as his close to 20 years of experience as an arbitrator.
Scott began serving as an arbitrator for FINRA (the Financial Industry Regulatory Authority) in 2008, for the AAA (American Arbitration Association) in 2018, and NAM (National Arbitration and Mediation) in 2018. Since 2008, Scott has served as an arbitrator on over 150 cases for FINRA, the AAA and NAM. The cases on which Scott has served involve recovery of investment losses, landlord/tenant, business torts, shareholder disputes, breach of contract, breach of fiduciary duty, fraud, personal guarantees, employment related issues and Georgia Lottery/COAM.
As a mediator and commercial arbitrator, Scott draws on over 40 years of legal experience handling business and commercial litigation to achieve dispute resolution through mediation and arbitration. Scott employs best practices when serving as a mediator and arbitrator. Scott recognizes the impact of implicit assumptions on decision making, and strives to be aware of implicit assumptions to ensure that he upholds the integrity and fairness of the mediation and arbitration process. Scott’s goal is for parties to be heard in mediation and arbitration, and for the parties to see and feel that the dispute resolution process is fair, and that they have had a full and fair opportunity to be heard and present their positions.
Scott’s recent litigation experience includes premises liability jury trial; final evidentiary hearings in contested AAA arbitrations; Georgia Supreme Court cases including privacy related issues and enforceability of personal guarantees; litigation of a fraudulent conveyance case; litigation of a breach of fiduciary duty case; federal court litigation regarding a lien discharge bond; federal court jury trial involving premises liability; and federal court jury trial of a first party insurance claim.
A graduate of the Emory University School of Law, Scott A. Schweber has been practicing law in Atlanta, GA since 1985. Scott has over 40 years of broad litigation experience representing individuals, closely held corporations, local and regional businesses, and national companies in trials, appeals, arbitrations and mediations throughout Georgia. Scott’s case experience includes business torts; contract disputes; shareholder litigation; commercial collections; labor and material liens; declaratory judgments and injunctive relief; FDIC claims; first party insurance claims and coverage disputes; personal guarantees; premises liability; real estate title disputes and foreclosure; contract bond claims and subrogation.
